Got The Latest On Drivers License Restrictions In Calif. for towing

Post by bsmall2800 on 8/19/2011, 5:29 pm

I was down at DMV to day getting some paper work done on a motorcycle purchase that I made. While I was there I figured I would get my class A non commercial drivers license. The lady brought out the new handbook governing all the new license restrictions. It says if you 5th wheel weighs less than 15,000 lbs GVWR nothing is required. You can drive and pull a 5th wheel weighing under 15000lbs with your simple class C drivers license. I know I have heard a lot of different opinions on this but this is what the book says. So we can put this rest once and for all.... If any one has any questions regarding restrictions just ask I brought the new handbook home.
Cheers,

That is a change this year. Must be. This was 2008 and you still needed a sticker.

http://www.dmv.ca.gov/pubs/dl648/dl648.pdf

This is 2011 and it says different.

I would call Sac before I would believe a office. In fact I am going to email them.

How does that work with people from other states? If another state requires less, does CA reciprocate and allow that driver to tow what would not be allowed for a particular license holder in
CA?

We wonder about that. We've never been pulled over, though, so aren't going to worry about it. If they want our tourism, I can only hope they reciprocate.

We haven't had to stop at scales in any of the states we've visited.

I believe you would only have to do that if you were a commercial vehicle. At least that's my understanding from long ago days when I would rarely have to drive a company truck across state lines.

I think most states require an endorsement or a non-commercial on towing over 10k. I have two endorsements on my non-commercial class C. One for over 10k towing and the other for a combination of vehicles not exceeding 70ft. The tests were the same as commercial less the air brakes portion.

A special test is still required for greater than 10k to 15k towing in California.

http://dmv.ca.gov/pubs/vctop/d06/vc12804_9.htm

I clipped some of the irrelevant sections

Code:

VC 12804.9

(3) Class C includes the following:

(F) (i) A two-axle vehicle weighing 4,000 pounds or more unladen when towing either a trailer coach or a fifth-wheel travel trailer not exceeding 10,000 pounds gross vehicle weight rating, when the towing of the trailer is not for compensation.

(ii) A two-axle vehicle weighing 4,000 pounds or more unladen when towing a fifth-wheel travel trailer exceeding 10,000 pounds, but not exceeding 15,000 pounds, gross vehicle weight rating, when the towing of the trailer is not for compensation, and if the person has passed a specialized written examination provided by the department relating to the knowledge of this code and other safety aspects governing the towing of recreational vehicles upon the highway.

State of California, Motor Vehicle Department said this today;

There are three parts to the endorsement for 10k to 15k 5th wheels.

1. Medical questions
2. Written test
3. Driving test.

What do you think our insurance companies would say, if we had an accident with our 5th wheels, and we did not have a legal license to drive one?
I for one will be going to our local DMV and getting the endorsement.

I wonder if you had an accident and didn't have the proper endorsement on your license, could you sue the dealer who sold you the FW for failure to notify you of regulations?

I would think that if a person could sue McDonalds for making coffee with hot water and not notifying them the coffee was hot, then you could certainly sue your dealer for failure to notify.

(sarcasm off)

Re: Got The Latest On Drivers License Restrictions In Calif. for towing

Post by Portagie1968 on 8/22/2011, 12:38 pm

Here is what the web site says and it is current.

Found at: http://dmv.ca.gov/pubs/cdl_htm/lic_chart.htm

Recreational Vehicles and Trailers Recreational Trailer Endorsement

A driver must have a fifth-wheel recreational trailer endorsement added to his/her Class C driver license to pull a fifth-wheel recreational trailer over 10,000 lbs., but not over 15,000 lbs. GVWR, which is not used for hire. This endorsement is not required if the driver has a Class A or Noncommercial Class A driver license.

There is no fee unless your license expires within six months.
You will take a law test for a noncommercial Class A license based on the information contained in this booklet. You must also pass the Class C law test unless you qualified for a Class C license within the past twelve months.
You are not required to submit a Health Questionnaire.
You are not required to take a driving test to add a Recreational Trailer endorsement to your current license.
No other tests are required.

So this makes 3 answers to the question.

When I went to the DMV last week, the gal (with 10+ years experience) who helped me said 80% of the staff were there less than 6 months.

At a prior visit, the DMV newbies where trying to tell me that I need to declare my truck's weight and my towed vehicles for non-commercial use. I printed out the statute stating otherwise.
I did update my WC declared weight to 13,500 to match my new VIN sticker. Cost $5 to reprint the registration.

Dawn down at the draw bridge by 5, 10 paces and then turn.

It is confusing down at DMV. Wait a minute it should be that is a government business.

Here is the Latest, Latest information;

I went to the DMV this morning and set up an appointment for the written test for Wednesday.

Here is what the book says, for a class C endorsement for 5th wheels between 10k and 15k.

1. You are not required to submit a health questionnaire.
2. You are not required to take a driving test to add a recreational trailer endorsement to your current license.
3. You will take a law test for a noncomercial class A license. You must also pass the class C law test unless you qualified for a class C license with the past twelve months.

I will try to remember some of the questions on the test.

Thanks everyone;

What made me decide to get going on this is was the following possibility.

Say you pull up to a stop light, with your WC, and are waiting for the light to turn green.
A car fails to stop and crashes into your WC. Someone in the car is injured. You get a ticket for operating a vehicle without a valid license. The occupant in the car sues you for their injuries. Your insurance company does not pay because you are operating a vehicle without a valid license. The guy now owns your house, and you are homeless. affraid

Those are very good points. The way the economy is going I bet an insurance company will do about anything to keep from paying.
